Training ban lifted for nursing assistance classes
Training classes for nursing assistants now can be offered in nursing homes that have been cited for deficiencies in other noncompliance areas, thanks to recent legislation passed by Congress.
Previously, facilities cited for noncompliance were prohibited from offering nursing assistance training programs. The new legislation is beneficial to providers in rural areas where the nursing facility is the only suitable place to train assistants with the appropriate equipment.
State regulatory agencies can waive the older federal law if the nursing facility meets certain qualifications. A waiver can be granted, for example, if the state determines that no other program is offered within reasonable distance to the facility. States also must provide a notice of waiver determination to the state long-term care ombudsman to qualify for a federal waiver.
