Two home care agencies found negligent
A jury in Boston has awarded a family of a 32-year-old slain home health care patient $26.5 million because the agencies hired to care for him failed to perform a criminal background check on an employee.
It was the largest negligent security verdict ever in the United States and the largest personal injury verdict in Massachusetts history. Trusted Health Resources Inc. in Boston and the Visiting Nurses Association, also in Boston, were defendants in the suit.
The judge ruled that the VNA is a charitable institution and, therefore, protected by a $20,000 liability cap. The VNA reached a settlement with the family. Trusted Health Resources, a for-profit organization, filed for bankruptcy under Chapter 7 of The Federal Bankruptcy Act.
